Program Description

In 2023, we experienced unprecedented legal developments and global challenges that are affecting employees’ expectations about inclusion, belonging and justice at work.  For example:

  • The US Supreme Court decided, in Students for Fair Admissions v. Harvard, that race-based affirmative action programs in college admissions processes violated the Equal Protection Clause of the 14th Amendment.
  • Local, national, and global events are influencing employee perspectives on discrimination, harassment, and backlash, requiring HR professionals to navigate complicated and novel issues of religion, culture and politics at work.
  • The EEOC is implementing strategic priorities examining policies and practices that discriminate against individuals with disabilities and/or individuals affected by pregnancy, childbirth, and related medical conditions under the Pregnancy Discrimination Act, as well as pregnancy-related disabilities under the Americans with Disabilities Act and the newly enacted Pregnant Workers Fairness Act, which requires employers to make reasonable accommodations for those affected by pregnancy, childbirth and related medical conditions.

This intersection of evolving judicial precedent, enhanced government agency scrutiny, employee social media advocacy, and post-pandemic adaptation has dramatically increased employee complaints across the United States.  And HR professionals are expected to address, investigate and resolve these charges in a process compounded by complex legal standards, challenging interpersonal dynamics, document review, and the ever-present threat of litigation and reputational harm.

In this session, we will:
  • Review changing legal standards, generational differences and global events that impact employee expectations in the workplace.
  • Discuss proactive and practical ways that employers can audit, protect, and strengthen their current and planned DEI and EEO practices, policies, and initiatives.
  • Explore best practices to design, distill, and execute an investigation process that yields a fair and defensible outcome.

Speaker: Misti Mukherjee, Esq.

The Founder of Extensio Law, Misti Mukherjee is a pragmatic, service-oriented lawyer, HR strategist and DEI practitioner who partners with employers in a wide range of issues related to employment law.  Misti’s expertise integrates a strategic, values-oriented approach.

Known for her commitment to high-quality legal service and counsel, Misti is consistently recognized for her excellent work. Named one of the “50 Influential Women of Virginia” by Virginia Lawyer’s Media, Misti has also been listed as one of the “Top 25 Women Attorneys” in Virginia by Richmond Magazine.  Selected for inclusion in the “Best Lawyers in America©” for Employment Law, Virginia’s Labor and Employment “Legal Elite” (Virginia Business magazine) and Virginia and Washington DC “Super Lawyers®” for Employment and Labor Law (Law and Politics magazine), Misti was also named a “SmartLawyer” by SmartCEO magazine.

Misti is also a dedicated and award-winning community leader.  She is the Vice Chair of the Board of Trustees of Luminis Health Anne Arundel Medical Center, a Trustee on the Board of Luminis Health, a Trustee on the Board of The Madeira School, and on the Advisory Boards of Dewey and Young Women Rise.  Misti is a past Chairman of the Board of Northern Virginia Family Service and HR Leadership Forum.  A champion of healthy and inclusive workplaces, Misti was Co-Chair of the Advisory Board of the CARE (Companies as Responsive Employer) Awards and a guest lecturer at Cornell University on issues of justice, equity and inclusion in the workplace.  She is an appointed member of the Leadership Fairfax Equity Council.

A critical thinker and evocative HR futurist, Misti is a sought after public speaker and the host of a popular podcast series extensio@work™, exploring topics of leadership, equity and community at work.  The Fairfax Law Foundation awarded Misti the “Golden Gavel Award”, in recognition of her service to the community.  In 2022, the March of Dimes recognized Misti’s exceptional volunteerism and leadership, naming her a Finalist for the “Heroines of Washington” Award.  

Misti was raised in West Africa and is conversant in three languages.  After graduating from The Madeira School and the Plan II Honors Program at the University of Texas at Austin, she received her law degree from the University of Texas School of Law. Prior to forming Extensio Law, Misti was Executive Vice President, General Counsel and Chief People Officer of a national company with more than14,000 employees.  For more than 30 years Misti has practiced employment law as a shareholder in both national and regional law firms.  Misti’s passionate and entrepreneurial commitment to equity, client service and innovation led her to her to form Extensio Law in April 2018.
